The Acquiring Authority published a Compulsory Purchase Order and Side Roads Order to deliver a Bypass scheme which would alter access to our client’s land. The scheme would have made access to our client’s land more circuitous and less commodious. Access would also have been downgraded to a private road, previously a public highway.
Through robust objections setting out the limitations of the Bypass scheme and the compensation claims which would therefore arise, the Acquiring Authority were convinced to withdraw the CPO and SRO, and design a revised scheme to include an additional arm to a main roundabout which would deliver direct access via a public highway to our client’s land. The revised bypass scheme has now been approved by the Secretary of State and costs were awarded to our client in respect of the withdrawn scheme.
